Trademark Maintenance Timeline
Registration Date
Your trademark is registered. 10-year clock starts. Mark your calendar now for year 5.
Cost: $250–$350 filing fee (already paid)
Years 5–6: First Maintenance Window
File Section 8 Declaration (you're still using the mark) and Section 9 Renewal. You can also file Section 15 here to claim incontestability if the mark has been in continuous use for 5 years.
Section 8: $225/class — sworn statement of continued use
Section 9: $300/class — renewal of registration
Section 15 (optional): $200/class — incontestability
Miss this window: 6-month grace period available, but costs $100 extra (Sec 8) and $200 extra (Sec 9) per class.
Year 7 Onward
No USPTO action needed. Monitor for infringement. Use the ® symbol. Keep records of your use in commerce.
Cost: $0
Years 9–10: Second Maintenance Window
Same filings as years 5–6. Section 8 + Section 9. No Section 15 option at this stage (already claimed or missed).
Section 8: $225/class
Section 9: $300/class
After this renewal: trademark remains active for another 10 years, then repeat.
Year 10+: Indefinite Renewal Cycle
Section 9 renewals every 10 years. $300/class each cycle. A trademark can last indefinitely as long as you keep using it and filing renewals.
Cost: $300/class every 10 years
What Happens If You Miss a Deadline
6-Month Grace Period
You have 6 months after each deadline window with a surcharge. Miss the grace period and your trademark is cancelled. No appeals, no exceptions except extraordinary circumstances.
Section 8 surcharge: +$100/class
Section 9 surcharge: +$200/class
Grace period total for 1 class: $825 vs. $525 on time
Cancellation
Cancelled trademarks lose federal registration and ® rights. You may still have common law rights based on use, but losing federal registration means losing the presumption of validity and the ability to block imports.
Refiling costs: $250–$350/class as a new application. You lose seniority and your original filing date.
